Acceptance of Terms
By accessing our website at happyhomesinterio.in or by engaging Happy Hommes for any interior design, consultation, procurement, or project management service, you agree to comply with and be legally bound by these Terms and Conditions.
These terms constitute a binding legal agreement between you ("Client") and Happy Hommes Interior Services ("Company", "we", "us", or "our"). If you do not agree to these terms, please refrain from using our services.
Services Offered
Happy Hommes provides professional interior design and related services, including but not limited to:
- Residential and commercial interior design consultation
- Space planning and layout design
- Furniture selection, sourcing, and procurement
- Material, finish, and colour specification
- Project management and site supervision
- 3D visualisation and mood board creation
- Turnkey interior fit-out execution
- Renovation and refurbishment services
All services are subject to availability and the execution of a formal project agreement or engagement letter prior to commencement.
Project Agreements
Every project undertaken by Happy Hommes will be governed by a separate written Project Agreement or Scope of Work (SOW) document. This document will clearly outline:
- Defined scope of work and project deliverables
- Project timelines and milestone schedules
- Agreed fees, payment structure, and billing schedule
- Site access requirements and client obligations
- Change request and revision procedures
In the event of any conflict between these general Terms and Conditions and the specific Project Agreement, the Project Agreement shall prevail.
Payments & Pricing
All fees and pricing are quoted in Indian Rupees (INR) and are exclusive of applicable taxes, unless otherwise stated in the Project Agreement.
- An advance payment (typically 30–50%) is required before project commencement
- Progress-linked milestone payments will be specified in the Project Agreement
- All payments must be made within the timelines stated in the invoice
- Late payments beyond 7 days may attract an interest charge of 1.5% per month
- Procurement of third-party materials may require full advance payment prior to ordering
Note: Quoted prices are valid for 30 days from the date of issue. Happy Hommes reserves the right to revise pricing in response to changes in vendor costs, material availability, or project scope alterations initiated by the Client.
Cancellation & Refunds
Cancellation of a project or engagement must be communicated in writing to Happy Hommes. The following conditions apply:
- Cancellation prior to design commencement: advance payment may be refunded minus any administrative or consultation fees already incurred
- Cancellation after design work has commenced: no refund is applicable for completed design phases
- Cancellation during execution/procurement phase: the Client is liable for all materials ordered, work completed, and third-party vendor commitments made on their behalf
- Refunds, where applicable, will be processed within 15–30 business days
Happy Hommes is not responsible for delays caused by force majeure events, including but not limited to natural disasters, supply chain disruptions, or government-mandated restrictions.
Intellectual Property
All design concepts, drawings, mood boards, 3D renders, layouts, and creative works produced by Happy Hommes remain the intellectual property of the Company until full and final payment has been received from the Client.
- Upon complete payment, the Client receives a non-exclusive licence to use the designs for the intended project only
- Designs may not be reproduced, resold, or used for commercial purposes without prior written consent
- Happy Hommes retains the right to use project photographs and design documentation in its portfolio, marketing materials, and social media, subject to Client's written objection
- The Client agrees not to replicate or commission third parties to replicate our design work without authorisation
Client Responsibilities
To ensure the smooth execution of your project, you agree to:
- Provide accurate site measurements, existing plans, and structural details in a timely manner
- Ensure safe and unobstructed access to the project site during agreed working hours
- Communicate design preferences, feedback, and approvals promptly and in writing
- Obtain all necessary permissions, NOCs, and approvals from housing societies, authorities, or landlords
- Ensure the project site is free from existing pest infestations, electrical hazards, or unresolved structural issues before design execution begins
Delays attributable to the Client, including delayed approvals or restricted site access, may result in revised timelines and additional charges, which will be communicated in advance.
Limitation of Liability
Happy Hommes shall not be held liable for:
- Any indirect, incidental, or consequential damages arising from the use of our services
- Defects, delays, or failures attributable to third-party vendors, contractors, or manufacturers
- Damage to existing fixtures, finishes, or property structures during approved site work, beyond reasonable care
- Variation in colour, texture, or finish between digital renders/samples and actual materials, as these are inherent to natural and manufactured materials
Our total aggregate liability to you under any circumstances shall not exceed the total fees paid to Happy Hommes for the specific project in question. This limitation applies to all claims, whether in contract, tort, or otherwise.
Privacy & Data
Happy Hommes is committed to protecting your personal information. Any data you share with us — including contact details, property information, and financial data — is used solely for the purpose of delivering our services and will not be sold or disclosed to third parties without your consent, except as required by law.
By engaging with us, you consent to the collection and use of your data for service delivery, project communication, and where agreed, promotional use (such as portfolio photography). You may withdraw consent for promotional use at any time in writing.
Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these terms or any project engagement shall be subject to the exclusive jurisdiction of the courts located in West Bengal, India.
Both parties agree to first attempt resolution through good-faith negotiation before initiating any formal legal proceedings.
Amendments to These Terms
Happy Hommes reserves the right to amend or update these Terms and Conditions at any time. Material changes will be communicated via our website or by direct notice to active clients. Continued engagement with our services following any amendment constitutes your acceptance of the revised terms.
